When our loved ones pass on, it is extremely important that their hard-earned wealth be passed on to the dependents and survivors in a dignified and expedient manner.
In the Kenyan context, there are two main way in which property of a deceased person passes on:

Intestacy -Where there is no will. In this case, the law envisages that property will only devolve to the family members or in their absence be transferred to the Government.

Testacy – Where there is a valid will and property is distributed according to the will.

Both testate and intestate succession call for a court process. In the case of testate succession, we take the will through probate and in the case of intestate succession, we apply for letters of administration.

The documents obtained at the end of the court processes are then used to transmit the property of the deceased so that the ownership changes from the name of the deceased to the name of the beneficiaries.
